Yeah, it shows how lame Square-Enix has become. They keep releasing the same god awful remakes year after year, but someone does a non-profit version of a cherished classic that they keep half-assing, and they shut it down.Honestly, the garbage that Square-Enix has been releasing lately makes me sick. They won't even remake Final Fantasy VII, but they've remade FFIV how many times now?Last I checked, Final Fantasy VII is still the most widely known game in the franchise.But I'm getting off topic, sorry.
Even so, legally, it's a grey area.They are somewhat tiptoeing around the legal issues.But it's unlikely that someone would be so malicious as to actually make a big deal out of it....I hope.
Theres always malicious people, Square Enix for example... i dont consider it more likely, instead, less likely, because the original game isn't running so shutting this one down wont make any difference(Userbase-wide), as Userbase is the main reason PServers get shut down so much...NTL or whoever was running the game(i dont remember) has to be over 9000 malicious level to shut down this sanctified Dragon Ball ground...

Just a heads up Simmy.Bandai-Namco does exist still, and they own Shonen Jump and Toei and therefor Dragon Ball if memory serves, so they can most certainly shut it down.At the very least, they own the rights to the games.Although, I don't think they will shut it down, they certainly can.
